The EB-5 investor green card

Entrepreneurs — along with their spouses and unmarried children under 21 — who invest in a U.S. commercial enterprise and create or preserve ten permanent, full-time jobs for qualified American workers may qualify for a green card. The program authorizes up to 10,000 visas each year.

Under the EB-5 Reform and Integrity Act of 2022, the minimum investment is $1,050,000, or at least $800,000 in a targeted employment area (a high-unemployment or rural area). These amounts are adjusted for inflation over time. Mississippi contains many qualifying targeted-employment zones.

Eligibility

You may qualify for permanent residence through investment if you:

  • Hold an approved Form I-526, Immigrant Petition by Alien Entrepreneur
  • Meet the admissibility requirements
  • Have an immediately available immigrant visa

You must also demonstrate that the funds were lawfully obtained and that the investment will generate full-time employment (35+ hours weekly) for at least ten U.S. citizens, permanent residents, or authorized workers.

The application process

We help prepare the Form I-526 petition to demonstrate investment in a suitable EB-5 project — through either a direct investment or an EB-5 Regional Center — and ensure proper project selection and complete filing. Applicants in the U.S. may obtain conditional permanent resident status through adjustment of status; those abroad may pursue it through consular processing.

Your family

Your spouse and unmarried children under 21 may be included as derivatives on the petition, and are counted toward the annual visa cap.
