A criminal record can make it difficult to obtain a good job and become a productive member of society. Fortunately, you may be able to have an eligible conviction erased by seeking an expungement.

When your record is expunged, the court orders the criminal record and arrest documentation to be destroyed.

Am I Eligible for an Expungement?

Eligibility depends on the type of offense and your history. General guidelines include the following.

Misdemeanors

If you have been convicted of a misdemeanor that is not a traffic violation and you are a first offender, you may be able to petition the court for an order to expunge the conviction from all public records.

Felonies

You may be able to petition the court to expunge a conviction five years after the successful completion of the terms and conditions of your sentence if the conviction was for one of the following offenses:

  • A bad check offense under Section 97-19-55;
  • Possession of a controlled substance under Section 41-29-139(c) or (d);
  • False pretense under Section 97-19-39;
  • Larceny under Section 97-17-41;
  • Malicious prosecution under Section 97-17-67; or
  • Shoplifting under Section 97-23-93.

Minors

Any person under 21 years of age at the time of committing a felony may petition the court for an order to expunge one conviction five years after the successful completion of the terms and conditions of the sentence. This right does not apply to a felony classified as a crime of violence under Section 97-3-2 or to any felony that the court determines was related to the distribution of a controlled substance.
